Terms and Conditions

Welcome to Esmalkia Safaris! Please carefully read and understand the following terms and conditions before booking with us.

  1. General Information and Booking Conditions
    Esmalkia Safaris, referred to as the ‘Company,’ is a registered entity under the laws of the Republic of Kenya. The term ‘Client’ pertains to the individual who has signed the booking form as the Lead Booking Name and includes all persons named in the booking. The ‘Agent’ denotes a company that has signed an Agent’s Contract and is booking on behalf of a Client to travel with Esmalkia Safaris.
  2. Contract
    A binding contract between the Company and the Client is established upon receipt of a 50% deposit or as mutually agreed upon in writing.
  3. Payments
    a. A deposit of 50% from each client is required upon submission of the booking form to reserve a booking, or 100% to confirm a booking, unless otherwise agreed upon.
    b. Full payment is due no less than 30 days prior to the date of arrival/start of services. Failure to comply may result in cancellation of the reservation.
    c. Payment methods accepted include Credit Cards (Visa Cards, Master Cards, American Express), with an additional 4% processing fee.
  4. Cancellations
    Any cancellations must be made in writing (email acceptable) and are subject to the following charges:
  • More than 120 days prior to departure: 30% of the total rate
  • 61 to 120 days prior to departure: 50% of the total rate
  • 31 to 60 days prior to departure: 70% of the total rate
  • 20 to 30 days prior to departure: 80% of the total rate
  • Less than 20 days prior to departure: 100% of the total rate
    Special cancellation fees may apply for 3rd party bookings.

5. Changes and Alterations of the Tour
The Company may vary or cancel any itinerary or arrangement in relation to the tour or safari due to Force Majeure. No refunds are given for circumstances beyond the Company’s control. Travel insurance is recommended.

6. Liability
Clients acknowledge and understand the risks of adventure travel and agree that the Company is not responsible for loss, injury, or damages unless caused by negligence.

7. Health and Age Restrictions
Clients must be medically fit and in good physical and mental health for the tour. Pre-existing medical conditions must be disclosed to the Company before the tour.

8. Claims and Complaints
In the event of a complaint, inform the Company immediately for a possible solution. Disputes unresolved through consultation will be submitted to relevant authorities in Kenya.

9. Client Responsibility
Clients are responsible for passports, visas, travel permits, and inoculations required for the tour. The Company is not liable for failure to comply with these requirements.

10. Travel Insurance
Travel insurance is mandatory for every client, covering personal injury, medical expenses, repatriation, and loss of luggage. The Company is not liable for medical expenses unless caused by negligence.
